The Right to Access Environmental Information:
An Analysis of UK Law in the Context of European, International and Human Rights Law

Synopsis: It is widely accepted that the right to access environmental information not only empowers citizens to seek and retrieve data about our environment, but is crucial for its protection. This book combines all the aspects of this important environmental right which are analysed in regard of UK national law, international law, EU law and the law of the European Convention on Human Rights (ECHR). The historical evolution of this right is the starting point for analysis. The substantive provisions of the Aarhus Convention, the 2003/4/EC Directive on public access to Environmental Information, the Freedom of Information Act 2000 and the Environmental Information Regulations 2004 are examined in parallel. Special attention is also given to specific UK enactments regarding registers containing environmental information. All relevant ECHR articles which have been interpreted as including a fundamental right to access environmental information are examined. This book is aimed at academics, law practitioners, environmentalists and any person wanting to gain an in-depth knowledge of UK, European and international law on access to environmental information.

i) Unlawful planning development and the right to peaceful enjoyment of possessions: the Antonetto case
[2002] Journal of Planning & Environment Law, June, pp. 674-683. 

In this article I discuss the fundamental human right of individuals to be protected by public authorities from unlawful neighbouring buildings that diminish the view, light and other amenities they can enjoy from their properties.
 
ii) Planning agreements and EC public procurement law
[2003] Journal of Planning & Environment Law, June, pp. 666-677. 

In this article I discuss the various issues that are raised by the European Court of Justice in the case of Ordine degli Architetti delle Province di Milano et Lodi v Comune di Milano.
 
iii)Dactylidi v. Greece
Brief thoughts on unlawful planning development and human rights.
I have written  a brief answer to queries addressed to the Journal of Planning & Environment Law concerning the Antonetto case and related issues. Published in the Correspondence section, [2002] J.P.L., October, pp. 1188-1189.
 
iv)  Planning Delays, Human Rights and Damages
[2005] 2, Environmental Law Review, p. 85
In this article I analyse the European Court of Human Rights case of Urbanczyk v Poland, in which the Human Rights Court found that long delays n obtaining a building permit may lead to a violation of article 6 of the European Convention of Human Rights and that as a consequence now states have to award compensation in cases of serious planning delays.

v) Noise Nuisance and the Right to Respect for Private and Family Life: the Moreno Gómez case
[2005] J.P.L. 584
This article examines the European Court of Human Rights ruling in Moreno Gomez v Spain (4143/02) on whether the failure of a local authority to take measures against noise nuisance which resulted in the applicant's insomnia and health problems amounted to a breach of the right to respect for home and family life under the European Convention on Human Rights 1950 Art.8. Compares the ruling in Hatton v United Kingdom (36022/97). Discusses statutory powers of local authorities in England and Wales to deal with noise pollution and the implications of the Moreno Gomez case.

vi) “The Issue of Costs in Accessing Environmental Information”
[2006] Journal of Planning & Environment Law, November, pp. 1-9.
This article aims to analyse the issue of costs in accessing environmental information in English law, in light of the very recent decision of the Information Tribunal in the case of David Markinson v The Information Commissioner.


4) PhD Research - Dissertations:

I have written a PhD thesis on the Right to request environmental Informationunder the supervision of  Prof. Michael Purdue at City University. I am examining all the aspects of this subject from an EU law, British law and human rights perspective. I am also adopting a comparative approach by comparing the British legal provisions on access to environmental information with the equivalent provisions in French law. Le droit d’accès général aux documents administratifs en France et en Grèce
Dissertation - thesis submitted at the University of Paris I - Sorbonne, for the award of the Master of Laws D.E.A. de Droit Public Comparé des Etats Européens. It is a comparative examination of general freedom of information legislation in France and in Greece  (in French).

 
Le droit d'accès aux documents administratifs au Royaume-Uni
Dissertation submitted at the University of Paris I - Sorbonne. It describes and analyses the UK Freedom of Information Act 2000 from a French lawyer's perspective. (in French)

 
La place de l’Eglise dans les institutions publiques en Grèce
Dissertation submitted at the University of Paris I - Sorbonne. It describes and analyses the constitutional position of the Greek church and the Mount-Athos in the Greek Constitution from a French lawyer's perspective.It also identifies possible conflicts between the Greek Constitution, which establishes the Greek Orthodox religion as the "dominant religion", and EU law.  (in French)   

5) Submissions to Conferences:

Le droit d’accès à l’information concernant l’environnement dans ses rapports avec le droit général d’accès à l’information administrative – Etude comparée du droit français et anglais
Paper presented at the First International Workshop for young Scholars, organised in France by the University of Aix-Marseille III and the European Law Journal.  It is a comparative study of the differences between the freedom to access environmental information and general freedom of information legislation in French and English law. Published as a chapter in the bilingual book: Francis Snyder (ed.), Comment protéger les intérêts du citoyen dans l'Union européenne d'aujourd'hui ? - Protecting the Interests of the Citizen in Today's European Union, Editions Bruylant, Brussels 2003.
